1. Acceptance of Terms

Welcome to Forem Care. These Terms of Service ("Terms") govern your access to and use of the Forem Care mobile application and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Please also review our Privacy Policy, which describes how we collect, use, and protect your personal information.

2. Description of Service

Forem Care is a caregiving coordination application designed to help families manage care for their loved ones. The Service includes features such as:

• Medication tracking and reminders
• Daily check-ins and wellness monitoring
• Emergency information storage
• Care circle coordination
• Doctor appointment scheduling
• Health information management

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age, or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

If you are creating an account for a care recipient who is a minor or lacks legal capacity, you represent that you are their parent, legal guardian, or have appropriate legal authority to act on their behalf.

4. Account Registration

4.1 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

4.2 Account Security

You are responsible for safeguarding your account credentials. We recommend using a strong, unique password and enabling any available security features such as biometric authentication.

5. Acceptable Use

5.1 Permitted Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for:

• Personal, non-commercial caregiving coordination
• Managing health information for yourself or those you are authorized to care for
• Communicating with care circle members you have invited

5.2 Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Access or use another person's account without authorization
• Enter false or misleading information
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service
• Transmit viruses, malware, or other harmful code
• Collect or harvest user information without consent
• Use the Service to harass, abuse, or harm others
• Impersonate any person or entity

6. Care Circle and Information Sharing

6.1 Inviting Care Circle Members

You may invite family members, caregivers, and other trusted individuals to join your care circle. By inviting someone, you:

• Confirm you have the authority to share the care recipient's information with them
• Accept responsibility for their appropriate use of the information
• Understand that they will have access based on the role you assign

6.2 Role-Based Access

Care circle members may be assigned different roles with varying access levels:

• Primary Caregiver: Full access to view and manage all information
• Backup Caregiver: Access to view and update most information
• Viewer: View-only access to selected information

6.3 Removing Members

You may remove care circle members at any time. Upon removal, their access to the care recipient's information will be revoked.

7. Health Information Disclaimer

You acknowledge and agree that:

• The Service does not provide medical advice
• Medication reminders are aids and should not replace professional guidance
• You should always verify medication information with healthcare providers
• In case of medical emergency, you should contact emergency services immediately
• We are not responsible for any health decisions made based on information in the app

8. User Content

8.1 Your Content

You retain ownership of all information, data, and content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited license to store, process, and display it as necessary to provide the Service.

8.2 Accuracy of Information

You are responsible for ensuring the accuracy and completeness of all User Content, especially health-related information. Inaccurate information may lead to inappropriate care decisions.

8.3 Backup Responsibility

While we implement measures to protect your data, you are encouraged to maintain your own backups of important information. We are not responsible for any loss of User Content.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Forem Care and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

9.2 Trademarks

"Forem Care" and associated logos are trademarks of Forem Care. You may not use our trademarks without prior written consent.

9.3 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use such feedback without compensation or attribution to you.

10. Third-Party Services

The Service may integrate with or contain links to third-party services. We are not responsible for the content, privacy practices, or actions of third parties. Your use of third-party services is at your own risk and subject to their terms and conditions.

11. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or updates
• Circumstances beyond our control

We will endeavor to provide advance notice of planned maintenance when possible.

12. Termination

12.1 Termination by You

You may terminate your account at any time by using the account deletion feature in the app or by contacting us. Upon termination, your right to use the Service will cease immediately.

12.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, including if we believe you have violated these Terms.

12.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Your User Content may be deleted after a reasonable retention period
• Provisions that should survive termination will remain in effect

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF INFORMATION

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOREM CARE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages arising from your use of the Service
• Any medical decisions or outcomes based on information in the Service

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Forem Care and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any User Content you submit

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forem Care regarding the Service.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.

18.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control.
